The Service uses the Website to provide services to Requesters and Providers.
1.4. “Mobile Application” may refer to one of the following programs:
1.4.1. “Taxsee Driver” is a program integrated with the Service's software and hardware system that enables the Provider to access the Database. It is installed on the Provider's device and allows the Provider to automate the access to information on existing orders for certain transportation services. Depending on the User’s country, the Mobile Application may have an alternative name containing the name “Taxsee Driver” and also “Maxim Driver” / “Taxsee Maxim Driver”.

“transportation services” also mean other services introduced by the Maxim Service from time to time.
1.4.2. “Maxim” is a program integrated with the Service's software and hardware system that enables the Requester to access the Database. It is installed on the Requester's device and allows the Requester to automate the process of placing orders for services. Depending on the User's country, the Mobile Application may have an alternative name containing the name "Maxim".
1.5. “Services” are the information provided to the Requester by the Service in order for the Requester's request to be accepted, processed and transferred to Providers, and for the Provider to be informed about the completion of such a request. 1.6. Categories of personal data owners whose data are subject to processing in accordance with this Policy:
1.6.1. “Requester” is an individual who has requested services via the Website, the Mobile Application or a Call Center Operator, and provided their personal data for this purpose.
1.6.2. “Provider” is an individual who, willingly, independently and using their own funds, provides transportation, freight delivery or loading/unloading services to the Requester and has provided their personal data for this purpose. The Service is not a transportation company and does not provide transportation services.
1.6.3. Visitors of the Website and other information resources of the Service.
1.7. “User” is an individual, including the Requester, the Provider, and other visitors of the Website and other information resources of the Service, who uses the Mobile Application or the Website and provides their personal data to the Service.
1.8. “Request” is an order for a ride, made by the Requester in order to receive services from Providers.
1.9. “Personal data processing” is any action/operation or set of actions/operations performed with personal data with or without the usage of automation tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modifying), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.10. “Automated personal data processing” is the processing of personal data by using computer technology.
1.11.“Provision of personal data” are actions aimed at obtaining the personal data of a particular individual or a group of individuals.
1.12. “Blocking of personal data” is a temporary suspension of personal data processing (except for when processing is necessary for identification of personal data).
1.13. “Destruction of personal data” are actions which render the existing personal data irretrievable and/or result in the destruction of physical media containing personal data.
1.14. “Information system of personal data” is a combination of personal data contained in the Database, and information technology and technical means enable the processing and protection of personal data.
1.15. “Cookies” are a set of data sent by the Website, stored on the computer, mobile phone or another device that the User uses to access the Website, and used for storage of information about the User's actions on the Website.
1.16. “Device Identifier” is unique information that serves to identify the User's device and is provided by the said device or calculated by the Mobile Application.
1.17. “Account” is a collection of information about the User required for identification of the User and providing the User with access to his/her personal data and personal settings, created via the Website or the Mobile Application by means of personal data provision.
1.18. “Database” is an organized structure consisting of a combination of materials, technical means, hardware, software, and methods, algorithms and/or program codes designed for systemization, storage, processing or conversion of information in accordance with database algorithms.
2. By using the Website, installing the Mobile Application on his/her devices or using the Mobile Application in any other form, the User agrees with the Terms of Use of the Maxim Service and the terms and conditions of this Policy, as well as provides his/her consent to the processing of his/her Personal data in cases when such consent is required in accordance with the applicable laws.
3. Personal data processing is implemented by the Service without the use of automation tools and/or with the use of automation tools by means of the Internet. When processed without the use of automation tools, personal data may be presented in the form of paper documents or electronic data on electronic media.
4. The Maxim Service verifies the information provided by the User in cases, to the extent and by the procedure provided for in the applicable laws and the Terms of Use of the Maxim Service. In other cases, the Service is unable to verify the authenticity of the information provided and the legal capacity of the User to provide it. Considering all of the above, the User is responsible for ensuring that the information provided by him/her is both authentic and timely updated and the Maxim Service presumes the abovementioned.
Rights and Obligations of the User and the Maxim Service 
5. During personal data processing, the User has the right to:

Request the Service to make additions to, block or delete the data or limit their processing if they are incomplete, inaccurate, gained unlawfully, or unnecessary for the stated purposes of the processing, as well as take the necessary actions to defend the User’s rights as provided for by the laws;

The User shall also be notified and given an opportunity to withhold consent to the processing in case of changes or any amendment to the information supplied or declared to the User.

A data subject is entitled to require a data controller through procedures prescribed in the regulations, to suspend or not to begin, processing of any personal data in respect of which he is the data subject, if the processing of such personal data is likely to cause substantial damage to him or to another person.
A data subject may require the data controller to stop processing his personal data for purposes of direct marketing.
5.3. Request the Service to cease the mailing of messages and notifications aimed at the promotion of products, events or promotional offers of the Service;
5.4. Defend his/her rights, including but not limited to by receiving compensation for pain and suffering, including but not limited to by taking legal action in court and other competent authorities;
5.5. Request the Service to delete the data in the Mobile Application by contacting support using his/her account (Menu - Support) or on the Website by contacting the method specified in the "Contacts" section, and request the Service to delete the Account in case the User created an Account and there are no unresolved issues with this Account (such as an incomplete request processing, a dispute, an inquiry from competent authorities, a debt); whereafter the account and the data are to be deleted within:
for Argentina:
5 days with the exception of the cases expressly provided for in Article 17 Law 25326 which are to be stored until the competent government authority permits its deletion, according to the aforementioned law;
for Azerbaijan:
7 business days;
for Brazil:
30 days with the exception as allowed by the applicable laws;
for Cambodia:
30 days with the exception as allowed by the applicable laws;
for Colombia:
15 business days except for cases when the Service requires additional information. In this case the Service has 5 business days to make an inquiry to the User and the User has two months to answer. After the response of the User, the Service has 8 days to resolve the request. If the recipient of the complaint is not competent to resolve it, they shall forward it to the appropriate party within a maximum period of 2 business days and inform the interested party of the situation;
for Indonesia:
3 days, with the exception of history of orders/activity which is/are to be stored for archiving;
for Kazakhstan:
1 business day in accordance with the applicable laws;
for Malaysia:
30 days with the exception of personal data which are to be stored for compliance with law, this Policy, or for purposes of safety, security, fraud prevention and detection according to the applicable data protection laws;
for Peru:
10 business days, except for data requested by a competent authority or required to be retained to comply with legal or contractual obligations. This data will be stored for the necessary period as per Law No. 29733 and its Regulations;
for the Philippines:
30 days with the exception as allowed by the applicable laws;
for South Africa:
30 days, data deletion timelines and exceptions might be subject to change based on specific regional laws;
for Tajikistan:
5 business days in accordance with the legislation of the Republic of Tajikistan;
for Thailand:
not more than 30 days with the exception of cases of denial according to the law or a court order;
for Vietnam:
3 days with the exceptions stipulated by the applicable laws;
for Tanzania:
30 days with the exception as allowed by the applicable laws;
5.6. Revoke his/her consent to personal data processing;
5.7. Not be affected by the decision made based solely on automated processing of personal data, express disagreement with a decision based on the automated processing;
for Argentina:
5.8. Request to receive a copy of the personal data in a format fit for its further transferring or request the Service to transfer the personal data to a processing agent specified by the personal data owner;
for Azerbaijan:
5.8. Receive information on whether the information systems that store any of his/her personal data have a certificate of compliance and have undergone a state expert review;

5.8. Request to receive a copy of the personal data in a format fit for its further transferring or request the Service to transfer the personal data to a processing agent specified by the personal data owner;

5.9. Complain, denounce, or take legal action in accordance with the provisions of the law;
5.10. Request compensation for damages in accordance with the provisions of the law when there is a violation of the provisions on the protection of his/her personal data, unless otherwise agreed by the parties or provided by the law.

6.4. The Service can only transfer the User's personal data to a third party in another country if:
6.4.1. The recipient country has an adequate level of data protection, this means the recipient country has laws and regulations in place that offer a comparable level of protection for personal data as POPIA. 
6.4.2. The transfer is based on a lawful justification, this includes obtaining the User's consent for the transfer, or if the transfer is necessary for the performance of a contract between the User and the Service.
6.4.3. The transfer is subject to appropriate safeguards, these safeguards ensure the data is protected throughout the transfer process, including:
6.4.3.1. Binding corporate rules (internal data transfer rules within a group of companies);
6.4.3.2. Standard Contractual Clauses (SCCs) approved by the Information Regulator. These are pre-drafted contractual clauses that set out specific data protection obligations for the data recipient;
6.4.3.3. Any other mechanism that ensures an adequate level of protection of personal data.
for Indonesia:
6.4. The Service can only transfer the User's personal data to a third party in another country if:
6.4.1. The recipient country has an adequate level of data protection, this means the recipient country has laws and regulations in place that offer a comparable level of protection for personal data as Law No. 27 of 2022 on personal data protection (“PDP Law”). 
6.4.2. The transfer is based on a lawful justification, this includes obtaining the User's consent for the transfer, or if the transfer is necessary for the performance of a contract between the User and the Service.
6.4.3. The transfer is subject to appropriate safeguards, these safeguards ensure the data is protected throughout the transfer process.
Any other mechanism that ensures an adequate level of protection of personal data.
for Vietnam:
6(a). During personal data processing, the User is obliged to:
6(a).1. Protect the User's own personal data; request relevant organizations and individuals to protect the User's personal data;
6(a).2. Respect and protect other Users' personal data;
6(a).3. Fully and accurately provide the User’s own personal data when the User consents to the processing;
6(a).4. Comply with regulations of law on protection of personal data and prevent violations against regulations on protection of personal data.
for Tanzania:
6.4. Personal data shall be transferred to country that has a legal framework that provides for adequate data protection, if-
6.4.1. the recipient establishes that the personal data is necessary for the performance of a task carried out in the public interest or pursuant to the lawful functions of a data controller; or 
6.4.2. the recipient establishes the necessity of having the data transferred and there is no reason to assume that the data subject's legitimate interests might be prejudiced by the transfer or the processing in the recipient country.
6.5. Personal data may be transferred to recipients states other than those referred to under section 6.4, if an adequate level of protection is ensured in the country of the recipient and the personal data is transferred solely to permit processing authorised to be undertaken by the controller. The adequacy of the level of protection afforded by the relevant third country shall be assessed in the light of:
6.5.1. all the circumstances surrounding the relevant personal data transfer;
6.5.2. nature of the personal data;
6.5.3. the purpose and duration of the proposed processing;
6.5.4. the recipient’s country;
6.5.5. the relevant laws in force in the third country; and 
6.5.6. the professional rules and security measures which are complied within that recipient’s country.
Types, Categories, Purposes and Procedure of Personal Data Processing 
7. The purpose of personal data collection and processing is the provision, personalization and improvement of services, which includes using personal data for the following purposes:
7.1. Provision of services;
7.2. Involvement in the provision of services;
7.3. Creation, administration and updating of accounts;
7.4. Identity confirmation;
7.5. Creation, acceptance and fulfillment of requests for rides, request fulfillment tracking, request cancellation;
7.6. Payment processing;
7.7. Personalization of offers, e.g., favorite destination points, previously selected destination points; 
7.8. Support, updating, error elimination and testing of software, monitoring and trend analysis in software usage and the Users' activity;
7.9. Insurance of safety of software and hardware used for the provision of services, including but not limited to:
7.9.1. Verification of Providers;
7.9.2. Identity confirmation upon logging in to the Account;
7.9.3. Use of the User's location, device and other data in order to prevent fraudulent and otherwise illegal activities;
7.9.4. Checking information related to requests received by the support service, provision of answers to received requests, resolution of issues in the Service's operation;
7.9.5. Monitoring of the User's compliance with the Terms of Use of the Maxim Service, License Agreement, this Privacy Policy and the applicable laws.
7.10. Settlement of disputes in accordance with the applicable laws;
7.11. Promotion of products, services, events and promotional offers of the Service and its contractors, including but not limited to by sending messages and notifications containing advertising materials, information on planned events and other information via phone, e-mail, mailing services, text messages (SMS), push notifications and applications (the User has the right to refuse to receive such messages and notifications);
7.12. Sending of non-promotional messages to the User (e.g., notifications about the Request status, support service replies, notifications containing information on changes in the operation of the Mobile Application).
8. The User provides his/her personal data of his/her own free will. If the User disagrees with the terms and conditions of this Policy, the User has the right not to accept them. 13. The Mobile Application may also request access to contacts and gallery. This function is not directly related to the use of the Mobile Application. 14. In some cases, the User may provide personal data of third parties to the Service (e.g., when giving the contact information of the User’s acquaintances or family members, or creating a request for a ride for a third party). In such cases, the User confirms that he/she has obtained the consent of such third parties for the processing of their personal data and confirms their agreement with this Policy and its acceptance.
15. If any personal data of a minor is disclosed to the Service, the User who provides such data and accepts this Policy, provides his/her consent to the processing of the minor's personal data as the minor’s legal representative or confirms that the User received the necessary consent from the minor's legal representative and agrees to the rules set forth by the present Policy regarding the rights of the minor. 16. The Service has the right to send promotional materials to the User's e-mail address. The User has the right to refuse to receive such materials by sending a corresponding request to the Service.
17. The User's personal data are to be deleted by the Service in the following cases:
17.1. after fulfilling the purpose of personal data processing, except for cases where there is another reason for storing the data, e.g., fulfillment of legal or contractual obligations, taking legal action with dispute settlement authorities;
17.2. if the User revokes his/her consent to the processing of his/her personal data.
18. Deletion of personal data is to be implemented in such a way as to render them irretrievable. Deletion of personal data is carried out if there are no obstacles to doing so, related to the requirements of the applicable laws or mutual obligations existing between the Service and the User. If there are any obstacles to the deletion of personal data, the Maxim Service keeps the User's request for data deletion until the end of the personal data storage term as stipulated by the applicable laws or until the clearance of any obstacles to the deletion of personal data. The User can request the deletion of his/her personal data in the Mobile Application by contacting support using his/her account (Menu - Support) or by sending a request by email, filing the applicable form on the website or otherwise in accordance with clause 21 of this Policy, unless otherwise provided by this clause, whereafter the data are to be deleted within:

19. Access to personal data is to be granted only to persons/entities directly involved in the provision of services. The Service has the right to grant access to the User's personal data to its employees. The Service and its employees have no right to disclose the User's personal data. Personal data may also be collected, stored and processed via other software products owned or used by the Service pursuant to agreements for use of such products entered into by the Service. The Service may also provide access to the User's personal data to third parties if the User gives his/her consent for the transferring of his/her personal data or if such personal data transfer is necessary to provide the User with a corresponding service or to fulfill a certain agreement or contract previously entered into or concluded with the User. In such cases, collection, storage and processing of personal data is carried out in the extent specified in this Policy, in accordance with the purposes specified in this Policy, and while providing the level of personal data protection required by the applicable laws. In cases specified by the applicable laws, the Service also provides access to personal data to any governing authority, law enforcement authorities, central or local bodies of executive power, and other officials, government agencies or courts to which the Service is obligated to provide information upon request in accordance with the applicable laws. 22. The Maxim Service is not responsible for the correct functioning and safety of the User's device and/or the network via which the User transfers his/her personal data. 23. The service receives information on the geographical location of the Requester and the Provider via the Mobile Application.
23.1. This information is transferred to the Service only when the Mobile Application is being used. The Requester and the User have the right to restrict such transfer at their discretion through settings on their devices. In case of restriction on transfer of information on geographical location, the Service cannot guarantee the correct functioning of the Mobile Application.
23.2. In order to complete a request, the Service may transfer the information on geographical location of the Requester to Providers who have accepted the request to fulfill the order, as well as information on the geographical location of the Provider to Requesters.
24. The Requester and the Provider can provide payment information to the Service.
24.1. The Requester and the Provider can link a bank card in the Mobile Application for making payments while using the Mobile Application in order to provide and receive services:
24.1.1. Bank card number;
24.1.2. Validity period of bank card;
24.1.3. CVV.

25. The Service receives information about the User's device.

1.1. "Data binafsi" ni taarifa yoyote inayohusiana moja kwa moja au kwa njia isiyo ya moja kwa moja na mtu mahususi (mmiliki wa data binafsi) na kuruhusu kumtambulisha mtu huyo.

1.2. "Service" / "Maxim Service" ni chombo cha kisheria ambacho huandaa au kutekeleza uchakataji wa data binafsi kwa kujitegemea, huamua madhumuni ya uchakataji wa data binafsi, muundo wa data binafsi kuchakatwa, hatua (shughuli) zitakazofanywa kwa kutumia data binafsi kwa mujibu wa Sera hii, na huwapa Watumiaji haki ya kutumia Kanzidata iliyo na taarifa iliyosasishwa juu ya mahitaji ya Waombaji wa huduma za Watoa huduma.

1.3. "Tovuti" ni seti ya programu za kompyuta na data nyingine zilizomo katika mfumo wa taarifa ambazo zinapatikana kupitia anwani ifuatayo ya intaneti:

 Service hutumia Tovuti kutoa huduma kwa Waombaji na Watoa huduma.

1.4. "Programu ya Simu ya Mkononi" inaweza kurejelea moja ya programu zifuatazo:

1.4.1. "Taxsee Driver" ni programu iliyounganishwa na programu na mfumo wa maunzi ya Service inayomwezesha Mtoa Huduma kufikia Kanzidata. Imesakinishwa kwenye kifaa cha Mtoa Huduma na inaruhusu Mtoa Huduma kufanya ufikiaji wa kiotomatiki wa taarifa kwenye oda zilizopo kwa huduma fulani za usafirishaji. Kulingana na nchi ya Mtumiaji, Programu ya Simu ya Mkononi inaweza kuwa na jina mbadala lililo na jina la "Taxsee Driver" na pia "Maxim Driver" / "Taxsee Maxim Driver".

 

kwa Malaysia:

"Huduma za usafirishaji" pia inamaanisha huduma zingine zilizoletwa na Maxim Service mara kwa mara.

 

1.4.2. "Maxim" ni programu iliyojumuishwa na mfumo wa programu na maunzi ya Service inayomwezesha Mwombaji kufikia Kanzidata. Inasakinishwa kwenye kifaa cha Mwombaji na inamruhusu Mwombaji kufanya mchakato wa kuweka oda za huduma kiotomatiki. Kulingana na nchi ya Mtumiaji, Programu ya Simu ya Mkononi inaweza kuwa na jina mbadala lililojumuishwa na jina "Maxim".

1.5. "Huduma" ni taarifa inayotolewa kwa Mwombaji na Service ili ombi la Mwombaji likubaliwe, kuchakatwa na kuhamishiwa kwa Watoa Huduma, na kwa Mtoa Huduma kujulishwa kuhusu kukamilisha ombi hilo. Mada na utaratibu wa huduma zinazotolewa kwa Mwombaji na Watoa huduma huamuliwa kwa kufuata Masharti ya Matumizi ya Maxim Service inayopatikana:

1.6. Aina za wamiliki wa data binafsi ambao data zao zinashughulikiwa kwa mujibu wa Sera hii:

1.6.1. "Mwombaji" ni mtu ambaye ameomba huduma kupitia Tovuti, Programu ya Simu ya Mkononi au Mfanyakazi wa Kituo cha Huduma kwa Wateja, na kutoa data yake binafsi kwa kusudi hili.

1.6.2. "Mtoa Huduma" ni mtu ambaye, kwa hiari, kwa kujitegemea na kwa kutumia fedha zake mwenyewe, hutoa huduma za usafirishaji, usafirishaji wa mizigo au upakiaji/upakuaji kwa Mwombaji na ametoa data yake binafsi kwa kusudi hili. Service si kampuni ya usafirishaji na haitoi huduma za usafirishaji.

1.6.3. Wageni wa Tovuti na nyenzo zingine za taarifa za Service.

1.7. "Mtumiaji" ni mtu binafsi, ikiwa ni pamoja na Mwombaji, Mtoa Huduma, na wageni wengine wa Tovuti na nyenzo zingine za taarifa za Service, anayetumia Programu ya Simu ya Mkononi au Tovuti na hutoa data zake binafsi kwa Service.

1.8. "Ombi" ni oda ya safari, inayotolewa na Mwombaji ili kupokea huduma kutoka kwa Watoa huduma.

1.9. "Uchakataji wa data binafsi" ni hatua/shughuli yoyote au seti ya vitendo/shughuli zinazofanywa kwenye data binafsi kwa kutumia au bila kutumia zana za kiotomatiki, ikiwa ni pamoja na ukusanyaji, kurekodi, upangiliaji, mkusanyiko, uhifadhi, ufafanuzi (kusasisha, kurekebisha), urejeshaji, utumiaji, uhamishaji (usambazaji, utoaji, ufikiaji), uondoaji, uzuiaji, ufutaji, uharibifu wa data binafsi.

1.10. "Uchakataji kiotomatiki wa data binafsi" ni uchakataji wa data binafsi kwa kutumia teknolojia ya kompyuta.

1.11."Utoaji wa data binafsi " ni vitendo vinavyolenga kupata data binafsi ya mtu fulani au kikundi cha watu binafsi.

1.12. "Kuzuia data binafsi" ni kusimamishwa kwa muda kwa uchakataji wa data binafsi (isipokuwa wakati uchakataji ni muhimu kwa utambuzi wa data binafsi).

1.13. "Uharibifu wa data binafsi" ni vitendo vinavyofanya data binafsi iliyopo isiweze kurejeshwa na/au kusababisha uharibifu wa nyenzo halisi zenye data binafsi.

1.14. "Mfumo wa taarifa wa data binafsi" ni mchanganyiko wa data binafsi zilizomo katika Kanzidata, na teknolojia ya habari na njia za kiufundi zinawezesha uchakataji na ulinzi wa data binafsi.

1.15. "Vidakuzi" ni seti ya data inayotumwa na Tovuti, iliyohifadhiwa kwenye kompyuta, simu ya mkononi au kifaa kingine ambacho Mtumiaji hutumia kufikia Tovuti, na hutumiwa kuhifadhi taarifa kuhusu vitendo vya Mtumiaji kwenye Tovuti.

1.16. "Kitambulisho cha Kifaa" ni taarifa ya kipekee ambayo hutumika kutambua kifaa cha Mtumiaji na hutolewa na kifaa hicho au kukokotolewa na Programu ya Simu ya Mkononi.

1.17. "Akaunti" ni mkusanyiko wa taarifa kuhusu Mtumiaji zinazohitajika kwa ajili ya kumtambua Mtumiaji na kumpa Mtumiaji ufikiaji wa data yake binafsi na mipangilio yake binafsi, iliyoundwa kupitia Tovuti au Programu ya Simu ya Mkononi kupitia utoaji wa data binafsi.

1.18. "Kanzidata" ni muundo uliopangwa unaojumuisha mchanganyiko wa nyenzo, mbinu za kiufundi, maunzi ngumu, programu, na njia, algoriti na/au misimbo ya programu zilizoundwa kwa ajili ya upangiliaji, uhifadhi, uchakataji au ubadilishaji wa taarifa kulingana na algoriti za kanzidata.

2. Kwa kutumia Tovuti, kusakinisha Programu ya Simu ya Mkononi kwenye vifaa vyake au kutumia Programu ya Simu ya Mkononi kwa namna nyingine yoyote, Mtumiaji anakubaliana na Masharti ya Matumizi ya Maxim Service na sheria na masharti ya Sera hii, pamoja na kutoa idhini yake kwa uchkataji wa data yake binafsi katika hali ambapo idhini hiyo inahitajika kwa mujibu wa sheria zinazotumika.

3. Uchakataji wa data binafsi unatekelezwa na Service bila kutumia zana za kiotomatiki na/au kwa kutumia zana za kiotomatiki kupitia Intaneti. Inaposhughulikiwa bila kutumia zana za kiotomatiki, data binafsi inaweza kuwasilishwa kwa njia ya nyaraka za karatasi au data ya kielektroniki kwenye nyenzo za kielektroniki.

4. Maxim Service inathibitisha taarifa iliyotolewa na Mtumiaji katika hali, kwa kiwango na kwa utaratibu uliotolewa katika sheria zinazotumika na Masharti ya Matumizi ya Maxim Service. Katika hali zingine, Service haiwezi kuthibitisha ukweli wa taarifa iliyotolewa na uwezo wa kisheria wa Mtumiaji kutoa taarifa hiyo. Kwa kuzingatia yote yaliyotajwa hapo juu, Mtumiaji anawajibika kuhakikisha kuwa taarifa aliyotoa ni ya kweli na imesasishwa kwa wakati unaofaa na Maxim Service inachukulia yaliyotajwa hapo juu kuwa ya kweli.

 

 

Haki na Wajibu wa Mtumiaji na Maxim Service

 

5. Wakati wa uchakataji wa data binafsi, Mtumiaji ana haki ya:

5.1. Kupokea taarifa zinazohusiana na uchakataji wa data yake binafsi, ikiwa ni pamoja na lakini si tu:

5.1.1. Uthibitisho wa uchakataji wa data binafsi;

5.1.2. Misingi ya kisheria na madhumuni ya uchakataji wa data binafsi;

5.1.3. Mbinu na madhumuni yanayotumika kwa uchakataji wa data binafsi;

5.1.4. Taarifa juu ya mtu/chombo kinachofanya uchakataji wa data binafsi, taarifa juu ya watu/vyombo ambavyo si wafanyakazi wa Service na wanapata idhini ya kufikia data binafsi, au juu ya watu/vyombo ambavyo data binafsi inaweza kufichuliwa kwa mujibu wa makubaliano mengine au sheria husika.

5.1.5. Ni data gani binafsi inayochakatwa na chanzo cha kuzipata, ikiwa sheria zinazotumika hazielezi utaratibu mwingine wa utoaji wake;

5.1.6. Muda wa uchakataji wa data binafsi na muda wa kuhifadhiwa kwake;

5.1.7. Haki za mmiliki wa data binafsi na njia za kuzitekeleza kulingana na sheria zinazotumika;

5.1.8. Taarifa kuhusu mtu/chombo kinachohusika na uchakataji, iwe kipo au kinawezekana kuwepo;

 

kwa Argentina:

5.1.9. Taarifa kuhusu uhamishaji wa data kimataifa;

5.1.10. Taarifa kuhusu mara ya mwisho data binafsi kubadilishwa;

5.1.11. Taarifa juu ya watu/vyombo ambavyo data binafsi ilifichuliwa kwao, na sababu za ufichuzi huo;

5.1.12. Taarifa zingine zilizoainishwa na sheria husika.

5.1.9. kupata taarifa kuhusu wapokeaji au makundi ya wapokeaji wa data binafsi ya Mtumiaji ambao wanakusudiwa au wanaweza kukusudiwa na taarifa hii.

5.1.10. mantiki ya ufanyaji maamuzi wa kiotomatiki unamuaathiri sana, ambapo uchakataji huo unaweza kuwa msingi pekee wa uamuzi wowote unaomuathiri sana Mtumiaji.

 

5.2. Omba Service ifanye nyongeza, kuzuia au kufuta data au kuweka ukomo wa uchakataji wake ikiwa haijakamilika, si sahihi, imepatikana kinyume cha sheria, au si lazima kwa madhumuni yaliyotajwa ya uchakataji, pamoja na kuchukua hatua muhimu kutetea haki za Mtumiaji kama ilivyoainishwa na sheria;

 

kwa Ufilipino:

na kupinga uchakataji wa data yake binafsi, ikiwa ni pamoja na uchakataji wa masoko ya moja kwa moja, uchakataji wa kiotomatiki au wasifu. Mtumiaji pia ataarifiwa na kupewa fursa ya kuzuia idhini ya uchakataji ikiwa kuna mabadiliko au marekebisho yoyote kwenye taarifa iliyotolewa au kutangazwa kwa Mtumiaji.

 

kwa Indonesia:

na kupinga uchakataji wa data yake binafsi, ikiwa ni pamoja na uchakataji wa masoko ya moja kwa moja, uchakataji wa kiotomatiki au wasifu. Mtumiaji pia ataarifiwa na kupewa fursa ya kuzuia idhini ya uchakataji ikiwa kuna mabadiliko au marekebisho yoyote kwenye taarifa iliyotolewa au kutangazwa kwa Mtumiaji.

 

Kwa Tanzania:

Mhusika wa data ana haki ya kuhitaji mdhibiti wa data kupitia taratibu zilizowekwa katika sheria, kusimamisha au kutoanza, kuchakata data yoyote binafsi ambayo yeye ndiye mhusika wa data, ikiwa uchakataji wa data hiyo binafsi unaweza kusababisha athari kubwa kwake au kwa mtu mwingine.

Mhusika wa data anaweza kuhitaji mdhibiti wa data kuacha kuchakata data yake binafsi kwa madhumuni ya uuzaji wa moja kwa moja.

 

5.3. Omba Service isitishe utumaji wa ujumbe na arifa zinazolenga kutangaza bidhaa, hafla au ofa za Service;

5.4. Kutetea haki zake, ikiwa ni pamoja na lakini si tu kwa kupokea fidia kwa maumivu na mateso, ikiwa ni pamoja na lakini si tu kwa kuchukua hatua za kisheria mahakamani na kwa mamlaka nyinginezo zinazofaa;

5.5. Omba Service kufuta data katika Programu ya Simu ya Mkononi kwa kuwasiliana na usaidizi kwa kutumia wasifu yake (Menyu - Usaidizi) au kwenye Tovuti kwa kuwasiliana kwa njia iliyobainishwa katika sehemu ya "Mawasiliano" na uombe Service kufuta Akaunti ikiwa Mtumiaji atafungua Akaunti na hakuna matatizo ambayo hayajatatuliwa kwenye Akaunti hii (kama vile uchakataji wa ombi ambalo halijakamilika, mzozo, uchunguzi kutoka kwa mamlaka husika, deni); ambapo baada ya hapo akaunti na data zinapaswa kufutwa ndani ya:

 

kwa Argentina:

Siku 5 isipokuwa kwa kesi zilizoainishwa wazi katika Kifungu cha 17 cha Sheria ya 25326 ambazo zinapaswa kuhifadhiwa hadi mamlaka husika ya serikali itakaporuhusu kufutwa, kwa mujibu wa sheria iliyotajwa hapo juu;

Siku 15 za kazi isipokuwa kwa kesi ambapo Service inahitaji taarifa za ziada. Katika hali hii Service ina siku 5 za kazi za kumuuliza Mtumiaji na Mtumiaji ana miezi miwili ya kujibu. Baada ya majibu ya Mtumiaji, Service ina siku 8 za kutatua ombi. Ikiwa mpokeaji wa malalamiko hana uwezo wa kuyasuluhisha, atayawasilisha kwa mhusika anayefaa ndani ya kipindi cha juu cha siku 2 za kazi na kumjulisha mhusika kuhusu hali hiyo;

 

kwa Indonesia:

Siku 3, isipokuwa historia ya oda/shughuli ambayo itahifadhiwa kwa ajili ya kumbukumbu;

 

kwa Kazakhstan:

Siku 1 ya kazi kwa mujibu wa sheria zinazotumika;

 

kwa Malaysia:

Siku 30 isipokuwa data binafsi ambazo zinapaswa kuhifadhiwa kwa kufuata sheria, Sera hii, au kwa madhumuni ya usalama, ulinzi, kuzuia udanganyifu na kugundua kulingana na sheria zinazotumika za ulinzi wa data;

 

kwa Peru:

Siku 10 za kazi, isipokuwa kwa data iliyoombwa na mamlaka yenye uwezo au inayohitajika kuhifadhiwa ili kuzingatia majukumu ya kisheria au ya kimkataba. Data hii itahifadhiwa kwa kipindi kinachohitajika kulingana na Sheria Na. 29733 na Kanuni zake;

 

kwa Ufilipino:

Siku 30 isipokuwa kama inaruhusiwa na sheria husika;

Siku 30 isipokuwa kama inaruhusiwa na sheria husika;

 

5.6. Kukanusha idhini yake ya uchakataji wa data binafsi;

5.7. Kutoathiriwa na uamuzi uliofanywa kwa kuzingatia tu uchakataji wa kiotomatiki wa data binafsi, kuonyesha kutokubaliana na uamuzi uliofanywa kutokana na uchakataji wa kiotomatiki;

 

kwa Argentina:

5.8. Omba kupokea nakala ya data binafsi katika muundo unaofaa kwa uhamishaji wake zaidi au omba Service ihamishe data binafsi kwa wakala wa uchakataji aliyebainishwa na mmiliki wa data binafsi;

 

kwa Azerbaijani:

5.8. Pokea taarifa juu ya ikiwa mifumo ya taarifa inayohifadhi data yake binafsi ina cheti cha kutii sheria na imefanyiwa ukaguzi na mtaalam wa serikali;

 

kwa Brazili:

5.8. Omba kupokea nakala ya data binafsi katika muundo unaofaa kwa uhamishaji wake zaidi au omba Service ihamishe data binafsi kwa wakala wa uchakataji aliyebainishwa na mmiliki wa data binafsi;

6. Wakati wa kuchakata data binafsi, Service inalazimika:

6.1. Kutoa taarifa ifuatayo juu ya ombi la Mtumiaji:

6.1.1. Uthibitisho wa uchakataji wa data binafsi;

6.1.2. Misingi ya kisheria na madhumuni ya uchakataji wa data binafsi;

6.1.3. Mbinu na madhumuni yanayotumika kwa uchakataji wa data binafsi;

6.1.4. Taarifa juu ya watu/vyombo ambavyo si wafanyakazi wa Service na wana idhini ya kufikia data binafsi, au juu ya watu/vyombo ambavyo data binafsi inaweza kufichuliwa kwao kwa mujibu wa makubaliano mengine au sheria zinazotumika.

6.1.5. Ni data gani binafsi inayochakatwa na chanzo cha kuzipata, ikiwa sheria zinazotumika hazielezi utaratibu mwingine wa utoaji wake;

6.1.6. Muda wa uchakataji wa data binafsi na muda wa kuhifadhiwa kwake;

6.1.7. Taarifa kuhusu haki za data binafsi na njia za kuzitekeleza kwa mujibu wa sheria zinazotumika;

6.1.8. Taarifa kuhusu mtu/chombo kinachohusika na uchakataji, iwe kipo au kinawezekana kuwepo;

6.4. Service inaweza tu kuhamisha data binafsi ya Mtumiaji kwa mtu mwingine katika nchi nyingine ikiwa:

6.4.1. Nchi ya mpokeaji ina kiwango cha kutosha cha ulinzi wa data, hii inamaanisha nchi ya mpokeaji ina sheria na kanuni ambazo zinatoa kiwango sawa cha ulinzi kwa data binafsi kama Ulinzi wa Taarifa Binafsi (POPIA).

6.4.2. Uhamisho unategemea haki halali, hii ni pamoja na kupata idhini ya Mtumiaji kwa uhamisho, au ikiwa uhamisho ni muhimu kwa utekelezaji wa mkataba kati ya Mtumiaji na Service.

6.4.3. Uhamisho unapaswa kuwa chini ya ulinzi unaofaa, ulinzi huu unahakikisha data inalindwa wakati wote wa mchakato wa uhamisho, ikiwa ni pamoja na:

6.4.3.1. Sheria zinazoongoza kampuni (sheria za uhamishaji wa data za ndani ya kikundi cha kampuni);

6.4.3.2. Vifungu vya Mikataba vya Kawaida (SCCs) vilivyoidhinishwa na Mdhibiti wa Taarifa. Hivi ni vifungu vya kimkataba vilivyoandaliwa mapema ambavyo vinaweka majukumu maalum ya ulinzi wa data kwa mpokeaji wa data;

6.4.3.3. Utaratibu mwingine wowote ambao unahakikisha kiwango cha kutosha cha ulinzi wa data binafsi.

6.4. Service inaweza tu kuhamisha data binafsi ya Mtumiaji kwa mtu mwingine katika nchi nyingine ikiwa:

6.4.1. Nchi mpokeaji ina kiwango cha kutosha cha ulinzi wa data, hii inamaanisha nchi mpokeaji ina sheria na kanuni ambazo zinatoa kiwango sawa cha ulinzi kwa data binafsi kama Sheria Na. 27 ya 2022 kuhusu ulinzi wa data binafsi ("Sheria ya Ulinzi wa Data Binafsi").

6.4.2. Uhamisho unategemea haki halali, hii ni pamoja na kupata idhini ya Mtumiaji kwa uhamisho, au ikiwa uhamisho ni muhimu kwa utekelezaji wa mkataba kati ya Mtumiaji na Service.

6.4.3. Uhamisho unapaswa kuwa chini ya ulinzi unaofaa, ulinzi huu unahakikisha data inalindwa wakati wote wa mchakato wa uhamisho, ikiwa ni pamoja na.

Utaratibu mwingine wowote ambao unahakikisha kiwango cha kutosha cha ulinzi wa data binafsi.

 

kwa Vietnamu:

6(a). Wakati wa uchakataji wa data binafsi, Mtumiaji analazimika:

6(a).1. Kulinda data binafsi ya Mtumiaji; omba mashirika husika na watu binafsi kulinda data binafsi ya Mtumiaji;

6(a).2. Kuheshimu na kulinda data binafsi ya Watumiaji wengine;

6(a).3. Kutoa data binafsi ya Mtumiaji kikamilifu na kwa usahihi wakati Mtumiaji anakubali uchakataji;

6.4. Data binafsi itahamishiwa nchi ambayo ina mfumo wa kisheria ambao hutoa ulinzi wa kutosha wa data, ikiwa-

6.4.1. mpokeaji anaonyesha kuwa data binafsi ni muhimu kwa ajili ya utekelezaji wa kazi iliyofanywa kwa maslahi ya umma au kwa mujibu wa kazi halali za mdhibiti wa data; au

6.4.2. mpokeaji anaweka umuhimu wa data kuhamishwa na hakuna sababu ya kudhani kuwa maslahi halali ya mhusika wa data yanaweza kuathiriwa na uhamishaji au uchakataji katika nchi mpokeaji.

6.5. Data binafsi inaweza kuhamishiwa kwenda kwenye majimbo ya wapokeaji isipokuwa kwa data iliyotajwa chini ya kifungu cha 6.4, ikiwa kiwango cha kutosha cha ulinzi kitahakikishwa katika nchi ya mpokeaji na data binafsi itahamishwa tu ili kuruhusu uchakataji ulioidhinishwa kufanywa na mdhibiti. Utoshelevu wa kiwango cha ulinzi kinachotolewa na nchi nyingine inayohusika utapimwa kwa kuzingatia:

6.5.1. hali zote zinazohusu uhamishaji wa data binafsi husika;

6.5.2. asili ya data binafsi;

6.5.3. kusudi na muda wa uchakataji uliopendekezwa;

6.5.4. nchi ya mpokeaji;

6.5.5. sheria husika zinazotumika katika nchi nyingine; na

6.5.6. sheria za kitaalamu na hatua za usalama ambazo ni.

 

 

Aina, Kategoria, Madhumuni na Utaratibu wa Uchakataji wa Data Binafsi

 

7. Madhumuni ya ukusanyaji na uchakataji wa data binafsi ni utoaji, kufanya iwe mahususi na uboreshaji wa huduma, ambazo ni pamoja na kutumia data binafsi kwa madhumuni yafuatayo:

7.1. Utoaji wa huduma;

7.2. Kushiriki katika utoaji wa huduma;

7.3. Uundaji, usimamizi na usasishaji wa akaunti;

7.4. Uthibitisho wa utambulisho;

7.5. Uundaji, ukubali na utimilifu wa maombi ya safari, ufuatiliaji wa utimilifu wa ombi, kughairiwa kwa ombi;

7.6. Uchakataji wa malipo;

7.7. Ufanyaji wa ofa kuwa mahususi, kwa mfano, maeneo unayopenda ya mwisho wa safari, maeneo ya mwisho wa safari yaliyochaguliwa hapo awali;

7.8. Kusaidia, kusasisha, kuondoa makosa na kupima programu, ufuatiliaji na uchambuzi wa mwenendo katika matumizi ya programu na shughuli za Watumiaji;

7.9. Kuhakikisha usalama wa programu na vifaa vinavyotumika katika utoaji wa huduma, pamoja na lakini si tu:

7.9.1. Uthibitishaji wa Watoa Huduma;

7.9.2. Uthibitishaji wa utambulisho wakati wa kuingia kwenye Akaunti;

7.9.3. Utumiaji wa maelezo ya mahali alipo Mtumiaji, kifaa na data nyingine ili kuzuia shughuli za ulaghai na haramu;

7.9.4. Kukagua taarifa zinazohusiana na maombi yaliyopokelewa na huduma ya usaidizi, utoaji wa majibu ya maombi yaliyopokelewa, utatuzi wa matatizo katika uendeshaji wa Service;

7.9.5. Ufuatiliaji wa Mtumiaji kutii Masharti ya Matumizi ya Maxim Service, Mkataba wa Leseni, Sera hii ya Faragha na sheria zinazotumika.

7.10. Utatuzi wa migogoro kwa mujibu wa sheria zinazotumika;

7.11. Utangazaji wa bidhaa, huduma, hafla na ofa za Serivice na wakandarasi wake, ikiwa ni pamoja na lakini si tu kwa kutuma ujumbe na arifa zilizo na nynezo za matangazo, taarifa juu ya hafla zilizopangwa na taarifa zingine kupitia simu, barua pepe, huduma za posta, ujumbe wa maandishi (SMS), arifa za ujumbe kwa watu wengi na programu (Mtumiaji ana haki ya kukataa kupokea ujumbe na arifa kama hizo);

7.12. Kutuma ujumbe usio wa matangazo kwa Mtumiaji (kwa mfano, arifa kuhusu hali ya Ombi, majibu ya huduma ya usaidizi, arifa zilizo na taarifa kuhusu mabadiliko katika uendeshaji wa Programu ya Simu ya Mkononi).

8. Mtumiaji hutoa data yake binafsi kwa hiari yake mwenyewe. Ikiwa Mtumiaji hatakubaliana na sheria na masharti ya Sera hii, Mtumiaji ana haki ya kutokubali. Hata hivyo, kutotoa data binafsi au kutotoa data binafsi ya kutosha kunaweza kuathiri uwezo wa Service kufikia madhumuni yaliyotajwa hapo juu, na uwezo wa Mtumiaji kutumia Service.

8.1. Mbali na kupokea data binafsi moja kwa moja kutoka kwa Mtumiaji, Maxim Service inaweza kupata data binafsi kama hiyo kwa njia zifuatazo:

8.1.1. kupitia Programu ya Simu ya Mkononi au Tovuti (kwa mfano, data ya maelezo ya mahali);

8.1.2. kutoka vyanzo vingine (kwa mfano, Watumiaji wengine, washirika wa biashara wa Service, mamlaka za serikali, vyanzo vya wazi).

9. Data binafsi ya Mtumiaji huhifadhiwa kwenye kontena za kielektroniki na kuchakatwa na mifumo ya kiotomatiki ya uchakataji wa data binafsi.

13. Programu ya Simu ya Mkononi inaweza pia kuomba idhini ya kufikia anwani za mawasiliano na matunzio ya picha. Utendaji huu hauhusiani moja kwa moja na matumizi ya Programu ya Simu ya Mkononi. Hata hivyo, ukiwa umezimwa, baadhi ya utendaji wa Programu ya Simu ya Mkononi huenda usipatikane. Utendaju huu pia unahitajika ili kufuatilia ikiwa Watoa huduma wanazingatia sheria zinazotumika.

14. Katika hali nyingine, Mtumiaji anaweza kutoa data binafsi ya wahusika wengine Service (kwa mfano, wakati wa kutoa maelezo ya mawasiliano ya watu anaowafahamu au wanafamilia wa Mtumiaji, au kuunda ombi la safari kwa wahusika wengine). Katika hali kama hizo, Mtumiaji anathibitisha kwamba amepata idhini ya watu hao wengine kwa ajili ya kuchakata data zake binafsi na anathibitisha makubaliano yao na Sera hii na kukubalika kwake.

15. Ikiwa data yoyote binafsi ya mtoto inafichuliwa kwa Service, Mtumiaji anayetoa data hiyo na anakubali Sera hii, anatoa idhini yake kwa uchakataji wa data binafsi ya mtoto kama mwakilishi wa kisheria wa mtoto au anathibitisha kwamba Mtumiaji amepokea idhini muhimu kutoka kwa mwakilishi wa kisheria wa mtoto na anakubali sheria zilizowekwa na Sera ya sasa kuhusu haki za mtoto. Ikiwa Mtumiaji ni mtoto, Mtumiaji anathibitisha kwamba anataarifa kuhusu wajibu wa kupokea idhini kutoka kwa mwakilishi wake wa kisheria na kwamba amepewa idhini hiyo kabla ya kukubali Sera hii.

16. Service ina haki ya kutuma nyenzo za matangazo kwenye anwani ya barua pepe ya Mtumiaji. Mtumiaji ana haki ya kukataa kupokea nyenzo hizo kwa kutuma ombi kwa Service la kutotaka kupokea nyenzo hizo.

17. Data binafsi ya Mtumiaji itafutwa na Service katika hali zifuatazo:

17.1. baada ya kutimiza kusudi la uchakataji wa data binafsi, isipokuwa kwa hali ambapo kuna sababu nyingine ya kuhifadhi data, kwa mfano, kutimiza majukumu ya kisheria au ya kimkataba, kuchukua hatua za kisheria na mamlaka ya utatuzi wa migogoro;

17.2. ikiwa Mtumiaji atabatilisha idhini yake ya kuchakata data yake binafsi.

18. Ufutaji wa data binafsi unapaswa kutekelezwa kwa njia ya kuzifanya zisipatikane. Ufutaji wa data binafsi unafanywa ikiwa hakuna vizuizi vya kufanya hivyo, vinavyohusiana na mahitaji ya sheria zinazotumika au majukumu ya pamoja yaliyopo kati ya Service na Mtumiaji. Ikiwa kuna vizuizi vyovyote vya kufuta data binafsi, Maxim Service hutunza ombi la Mtumiaji la kufuta data hadi mwisho wa muda wa kuhifadhi data binafsi kama ilivyoelezwa na sheria husika au hadi vizuizi vyovyote vya kufuta data binafsi vitakapoondolewa. Mtumiaji anaweza kuomba kufutwa kwa data yake binafsi katika Programu ya Simu kwa kuwasiliana na usaidizi kwa kutumia wasifu yake (Menyu - Usaidizi) au kwa kutuma ombi kwa barua pepe, kuwasilisha fomu inayotumika kwenye tovuti au vinginevyo kwa mujibu wa kifungu cha 21 cha Sera hii, isipokuwa kama imetolewa vinginevyo na kifungu hiki, ambapo data inapaswa kufutwa ndani ya:

Siku 5 isipokuwa kwa kesi zilizoainishwa wazi katika Kifungu cha 17 cha Sheria ya 25326 ambazo zinapaswa kuhifadhiwa hadi mamlaka husika ya serikali itakaporuhusu kufutwa, kwa mujibu wa sheria iliyotajwa hapo juu.

Ikiwa mpokeaji wa malalamiko hana uwezo wa kuyasuluhisha, atayawasilisha kwa mhusika anayefaa ndani ya kipindi cha juu cha siku 2 za kazi na kumjulisha mhusika kuhusu hali hiyo.

19. Idhini ya kufikia data binafsi unapaswa kutolewa tu kwa watu/vyombo vinavyohusika moja kwa moja katika utoaji wa huduma. Service ina haki ya kutoa idhini ya kufikia data binafsi ya Mtumiaji kwa wafanyakazi wake. Service na wafanyakazi wake hawana haki ya kufichua data binafsi ya Mtumiaji. Data binafsi pia inaweza kukusanywa, kuhifadhiwa na kuchakatwa kupitia bidhaa zingine za programu zinazomilikiwa au kutumiwa na Service kulingana na makubaliano ya matumizi ya bidhaa hizo zilizoingizwa na Service. Service pia inaweza kutoa idhini ya kufikia data binafsi ya Mtumiaji kwa wahusika wengine ikiwa Mtumiaji atatoa idhini yake ya kuhamisha data yake binafsi au ikiwa uhamishaji huo wa data binafsi ni muhimu ili kumpa Mtumiaji huduma inayolingana au kutimiza makubaliano fulani au mkataba ambao hapo awali uliingizwa au kuhitimishwa na Mtumiaji. Katika hali kama hizo, ukusanyaji, uhifadhi na uchakataji wa data binafsi unafanywa kwa kiwango kilichobainishwa katika Sera hii, kwa mujibu wa madhumuni yaliyobainishwa katika Sera hii, na huku ukitoa kiwango cha ulinzi wa data binafsi kinachohitajika na sheria zinazotumika. Katika hali zilizoainishwa na sheria zinazotumika, Service pia hutoa idhini ya kufikia data binafsi kwa mamlaka yoyote inayosimamia, mamlaka za utekelezaji wa sheria, vyombo vya serikali kuu au vya mitaa, na maafisa wengine, mashirika ya serikali au mahakama ambazo Service inalazimika kutoa taarifa itakapoombwa kulingana na sheria zinazotumika. Kwa kukubali Sera hii ya Faragha, Mtumiaji anakubali sheria na masharti yaliyotajwa hapo juu.

20. Service inachukua hatua zifuatazo ili kuzuia ufikiaji usioidhinishwa wa data binafsi ya Mtumiaji:

20.1. Kuajiri wafanyakazi wanaowajibika kuandaa uchakataji wa data binafsi;

20.2. Kutumia hatua za shirika na kiufundi ili kuhakikisha usalama wa data binafsi ya Mtumiaji. Hatua hizo ni pamoja na:

20.2.1. Kugundua hatari za usalama katika mfumo wakati wa kuchakata data binafsi;

20.2.2. Kutumia mifumo ya usalama iliyopo katika majengo yanayohifadhi mifumo ya taarifa katika namna ya kuzuia watu wasioidhinishwa kuingia kwenye majengo hayo;

20.2.3. Kuhakikisha usalama wa uhifadhi wa data binafsi;

20.2.4. Kuidhinishwa kwa orodha ya watu wenye kibali cha kufikia data binafsi katika uwezo wao rasmi;

20.2.5. Kutumia hatua zinazohitajika kulinda data binafsi dhidi ya ufikiaji usioidhinishwa;

20.2.6. Tathmini ya hatua zilizochukuliwa;

20.2.7. Kuhakikisha uwezekano wa kugundua ufikiaji usioidhinishwa wa data binafsi;

20.2.8. Kurejesha data iliyofutwa au kuharibiwa kutokana na ufikiaji usioidhinishwa (ikiwezekana);

20.2.9. Udhibiti wa ufikiaji wa data binafsi ndani ya mfumo baada ya kuchakatwa;

20.2.10. Kudhibiti hatua zilizochukuliwa kulinda data binafsi na kiwango cha ulinzi wa mifumo ya taarifa.

21. Kutumia haki za Mtumiaji zilizoorodheshwa katika Sera hii na zinazotolewa na sheria zinazotumika, pamoja na maombi ya ufafanuzi wa Sera hii hufanywa kwa kutuma ombi kwa njia ya maandishi kwenda Maxim Service kupitia posta, barua pepe, au kwa kuwasilisha ombi hilo binafsi mahali ilipo Service. Ni lazima maombi kama hayo yawe na yafuatayo: Namba ya hati ya kitambulisho cha Mtumiaji au mwakilishi wake, tarehe ya kutolewa kwa hati hii, anwani ya makazi ya Mtumiaji, taarifa inayothibitisha shughuli za pamoja kati ya Mtumiaji na Service (nambari ya Kitambulisho cha Mtumiaji) au taarifa ambayo, kwa njia fulani, huunda au kutengeneza, kuthibitisha uchakataji wa data binafsi ya Mtumiaji, ombi la kuongeza, kuzuia au kuondoa data binafsi ya Mtumiaji, arifa ya kufuta idhini ya uchakataji wa data binafsi, au ombi lingine la Mtumiaji, saini ya Mtumiaji au mwakilishi wake.

22. Maxim Service haiwajibiki kwa utendaji sahihi na usalama wa kifaa cha Mtumiaji na/au mtandao unaotumiwa na Mtumiaji huhamisha data yake binafsi. Ili kuongeza kiwango cha usalama, Service inapendekeza Mtumiaji azingatie tahadhari zifuatazo (bila, hata hivyo, kuhakikisha kuzuia matukio yanayohusiana na sababu zilizotajwa hapo juu):

22.1. Ingia katika akaunti na utumie Programu ya Simu ya mkononi na Tovuti wakati tu unatumia mitandao inayoaminika;

22.2. Epuka kutembelea tovuti zisizo salama;

22.3. Kutoziamini simu, barua pepe, ujumbe na arifa zingine ulizopokea kutoka katika vyanzo visivyojulikana, epuka kufuata viungo vinavyotiliwa shaka;

23. Service inapokea taarifa kuhusu eneo la kijiografia la Mwombaji na Mtoa Huduma kupitia Programu ya Simu ya Mkononi.

23.1. Taarifa hii huhamishiwa tu kwenda Service wakati Programu ya Simu ya Mkononi inatumika. Mwombaji na Mtumiaji wana haki ya kuzuia uhamishaji huo kwa hiari yao kupitia mipangilio kwenye vifaa vyao. Katika hali ya kizuizi juu ya uhamishaji wa taarifa juu ya eneo la kijiografia, Service haiwezi kuhakikisha utendaji sahihi wa Programu ya Simu ya Mkononi.

23.2. Ili kukamilisha ombi, Service inaweza kuhamisha taarifa kuhusu eneo la kijiografia la Mwombaji kwa Watoa huduma ambao wamekubali ombi la kutimiza oda, pamoja na taarifa kuhusu eneo la kijiografia la Mtoa Huduma kwa Waombaji.

24. Mwombaji na Mtoa Huduma wanaweza kutoa taarifa za malipo kwa Service.

24.1. Mwombaji na Mtoa Huduma wanaweza kuunganisha kadi ya benki katika Programu ya Simu ya Mkononi kwa ajili ya kufanya malipo wakati wa kutumia Programu ya Simu ya Mkononi ili kutoa na kupokea huduma:

24.1.1. Nambari ya kadi ya benki;

24.1.2. Kipindi cha uhai wa kadi ya benki;

24.1.3. CVV.

(Kifungu cha 24.1 ikiwa ni pamoja na vifungu vya 24.1.1-24.1.3 havitumiki nchini Vietnamu na Peru)

25. Service inapokea taarifa kuhusu kifaa cha Mtumiaji.

25.1. Taarifa kuhusu kifaa cha Mtumiaji haina data yoyote binafsi na si sehemu ya seti ya data ambayo inaweza kutumika kumtambua Mtumiaji.

25.2. Taarifa hii hukusanywa kwa madhumuni ya ufuatiliaji wa ndani wa Programu ya Simu ya Mkononi na watumiaji wa Tovuti, na kuboresha utendaji wa Programu ya Simu ya Mkononi na Tovuti.

26. Service inapokea taarifa kuhusu mwendeshaji wa mtandao wa simu ambaye hutoa huduma zake kwa Mtumiaji kupitia Programu ya Simu ya Mkononi.

26.1. Taarifa kuhusu mwendeshaji wa mtandao wa simu anayetoa huduma kwa Mtumiaji haina data yoyote binafsi na si sehemu ya seti ya data ambayo inaweza kutumika kumtambua Mtumiaji.

26.2. Taarifa hii hukusanywa kwa madhumuni ya uteuzi wa kiotomatiki wa nchi ya makazi ya Mtumiaji na lugha ya kiolesura cha Mtumiaji katika mipangilio ya Programu ya Simu ya Mkononi.

27. Service huhifadhi taarifa kuhusu historia ya oda ya Mwombaji na Mtumiaji.

27.1. Rekodi za barabara zinajumuisha wakati wa kuanzishwa kwa ombi, anwani ya kuwasili kwa gari, anwani ya mahali unakoenda na njia zilizochaguliwa, daraja lililotumika, njia ya malipo na taarifa nyingine zinazotolewa na Mwombaji.

27.2. Taarifa hii hukusanywa kwa madhumuni ya kuboresha ubora wa huduma kwa kujaza kiotomatiki vigezo vya ombi kwa kutumia taarifa zilizotolewa hapo awali ili kupunguza muda unaohitajika kutimiza ombi.

 

 

Vidakuzi

 

28. Service inaweza kutumia vidakuzi vifuatavyo:

28.1. Vidakuzi vya muhimu sana. Vidakuzi hivi ni vya lazima kwa ajili ya kuvinjari kwenye Tovuti. Vidakuzi hivi hutumiwa wakati Mtumiaji anajiandikisha na/au kuingia kwenye mfumo. Bila vidakuzi hivi, huduma hazipatikani. Vidakuzi hivi ni vya mtoa huduma mkuu na vinaweza kuwa vya kudumu na vya vipindi. Bila vidakuzi hivi, Tovuti haitafanya kazi vizuri.

28.2. Vidakuzi vya utendaji. Vidakuzi hivi hukusanya data ya takwimu kuhusu kutumia Tovuti. Havikusanyi data binafsi ya Mtumiaji. Data yoyote na data zote zilizokusanywa na vidakuzi vya utendaji ni vya kitakwimu na visivyobainishwa. Vidakuzi hivi vinaweza kuwa vya kudumu na vya vipindi. Vinaweza pia kuwa vya mtoa huduma mkuu na mtoa huduma mwingine. Vinatumika kwa ajili ya:

28.2.1. kukusanya takwimu za matumizi ya Tovuti;

28.2.2. kutathmini ufanisi wa kampeni za matangazo.

28.3. Vidakuzi vya utendaji kazi. Vidakuzi hivi hutumiwa kuhifadhi taarifa zinazotolewa na Mtumiaji (kwa mfano, jina, lugha na/au eneo la Mtumiaji). Faili hizi hutumia taarifa isiyojulikana na hazifuatilii shughuli za Mtumiaji kwenye tovuti zingine. Vidakuzi hivi vinaweza kuwa vya kudumu na vya vipindi. Vinaweza pia kuwa vya mtoa huduma mkuu na mtoa huduma mwingine. Vinatumika kwa ajili ya:

28.3.1. kuhifadhi taarifa juu ya huduma zinazotolewa kwa Mwombaji;

28.3.2. kuboresha utendaji wa Tovuti, mara nyingi kwa kuhifadhi machaguo ya Mtumiaji.

28.4. Vidakuzi vya matangazo. Vidakuzi hivi hutumiwa kupunguza idadi ya mionekano ya matangazo, pamoja na kutathmini ufanisi wa kampeni za matangazo. Vidakuzi vya matangazo hutumiwa kudhibiti maudhui ya matangazo kwenye Tovuti. Vidakuzi vya matangazo huwekwa na wahusika wengine, kwa mfano, watangazaji na mawakala wao. Vidakuzi hivi vinaweza kuwa vya kudumu na vya vipindi. Faili hizi zimeunganishwa na matangazo kwenye Tovuti, ambayo hutolewa na kampuni za wahusika wengine.

29. Kuzuia, kufuta au ukomo wa shughuli za vidakuzi kunaweza kupatikana katika mipangilio ya kivinjari cha Mtumiaji.
